Ordering and Delivery
When you place an order to purchase a product online from https://gardenfurnitureengland.co.uk, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send an e-mail, or other confirmation, that we've dispatched that product to you, or you receive the product. That acceptance will be complete at the time we send this information to you. By placing an order you are consenting that you have read, understood and will abide by our terms and conditions. Garden Furniture England are under no obligation to supply any goods to you that you make an offer to purchase.
Free Delivery applies to goods ordered on our website where Free Delivery is stated. Delivery will not be charged on deliveries made during normal hours operated by our logistics partners. This is usually, but not always, Monday to Friday 9am- 5pm. Deliveries on a Saturday will normally incur an extra charge. Free delivery is only to Mainland UK destinations where a sea crossing (other than by bridge) is not required from our warehouses to the final destination.
Please note that dispatch estimates are not exact. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, we will inform you by e-mail if any items you order turn out to be unreasonably delayed (more than 28 days).
We endeavour to dispatch items in stock within 96 hours. We do not always have warehouse stock of all items, where this is the case, we endeavour to dispatch to you within 28 days. Where this is not possible, we will endeavour to email you with an analysis of the likely dispatch time. You can cancel your order at any time up until the item is dispatched, where upon we will refund the amount paid by you in full. Thereafter, please refer to our returns policy.
Delivery will be deemed as successfully made once the product has arrived at the address specified. No signature is required for proof of delivery, except where carriers use this for their own confirmation. Products may be left at the delivery address without the recipient's permission except where third party suppliers require signed confirmation or the recipient has expressly requested products not be delivered in their absence.
As soon as we have delivered the goods, you will be responsible for them. If you delay a delivery, our responsibility for everything other than damage due to our negligence will end on the date we originally agreed to deliver them.
In case of delivery to certain locations such as hospitals, airports, hotels, ships and other business premises, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of Delivery.
Should delivery be refused at the delivery address, and re-requested for another date, we may charge for the second delivery, since we met our delivery obligations with the initial delivery attempt.
It is the Recipients responsibility to sign for the correct number of packages as shown on the carrier's Delivery consignment note. Shortages or damages must be noted on the consignment note where possible. You must notify us of any shortages or damages within a reasonable time after delivery has taken place..
Pricing and availability
Despite our efforts, occasionally, items on our website are priced incorrectly. If, prior to dispatch we find a product's correct price is lower than our stated price, we will refund the overcharge and send you the product. If a product's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.
All prices are inclusive of VAT a the current rate unless stated otherwise. All prices are listed in GBP. We will charge your credit or debit card or other payment method at the time your order is placed. We reserve the right to charge a reasonable supplementary administration charge in relation to credit and debit card transactions in accordance with the policies of Visa and Mastercard and other credit/debit card providers. If, however, your order is unreasonably delayed, we will make contact with you to discuss a course of action which can include cancellation of your order and full refund, or refund until item is ready for dispatch, or mutually acceptable course of action. We will not dispatch goods to you until payment is received, or an authorised person employed by Garden Furniture England or our parent Garden Furniture Scotland Ltd has agreed to this course of action.
Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and conditions in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition. We will not be held responsible for any delay or failure to comply with our obligations if there is a delay or failure arising from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
Gift Certificates
Gift Certificates can not be refunded or exchanged for another voucher. The certificate can only be used as payment for goods from the websites named on the certificate. You can use all, or some of the amount, but no refund will be given in respect of unused proportion. Gift Certificates are valid for 1 year from date of issue. Certificate can be used multiple times until balance is zero.
Personal Information
We will use your personal information only in relation to orders you place with us, or to keep you informed, on rare occasions, of promotions being offered by Garden Furniture England or other websites operated by Garden Furniture Scotland Ltd. We will never sell your personal details including email addresses to any 3rd party. All personal data is held in accordance with the laws governing the United Kingdom.
Returns and Cancellation
If you are unhappy with your item, you may return it to gardenfurnitureengland.co.uk within 14 days after the date of delivery. You must also confirm your wish to cancel in writing via email or post within this time period. The item must be returned in undamaged and unused condition. Returns may be subject to a £50 restocking fee, at our discretion. We reserve the right to refuse returns or to charge you for our reasonable cost if the product is received otherwise than in accordance with these requirements. All postal costs relating to the return of an item is the responsibility of the customer. Once returned, goods will be inspected and a refund issued. If the inspection reveals damage, or are returned in poor condition, we will reduce the amount of refund paid by a consumerate amount as decided by our expert staff.
We will, in the event of item being damaged on receipt by the customer, at our discretion, re-imburse postage costs to the customer at the cheapest rate the return can be made by the customer regardless of the service used by the customer.
If the item is defective, this must be notified to us within 48 hours of delivery. Please contact gardenfurnitureengland.co.uk. by phone or email and we will discuss the defect and action to be taken. We ask that where possible you provide digital photographs of the fault to assist in our assessment of the problem.
If you cancel the contract to purchase prior to dispatch of the goods, we will make reimbursement without undue delay, and not later than 14 days after we have received notification of the cancellation. If you cancel the contract to purchase, after dispatch of the goods, you will be liable for return of the goods at your cost. Once the goods have been received by us, we will make reimbursement without undue delay, and not later than 14 days after we have received the returned goods. Reimbursement will be made by the same means as the original payment.
